WILLEMSTAD.- Holland on the one hand, and Curaçao, Aruba and San Martin on the other, are not on the same page with regard to the settlement of dispute. But since the beginning that the delegation of Curaçao traveled to Holland, they sat down to analyze what were the points of conflict in this matter. One of the parties is that the Dutchman has a problem with an independent body, in this case, probably a judge, making decisions conclusively and definitively. Apparently Dutch politicians have a bit of trouble handing this part into the hands of others so that those are the ones who decide, this according to the member of Parliament Dr. Marilyn Moses, during a meeting with the press yesterday in the framework of the meeting of IPKO in the Netherlands recently.
According to Dr. Moses, the indication is that there is a fear factor, but when people show fear in something like that, it is due to lack of information. But they have been explained very clearly, why there is a need for a dispute settlement. Moreover, it is logical that if there are four countries within a Kingdom, points of dispute will arise, and even regarding the current situation with Venezuela. If there was clarity on Article 43 of the Statute for example, there would be no dispute but action would be taken immediately. The point mentioned here, could be one that could perhaps be submitted to an impartial arbitration.
The Netherlands can make use of Art. 43 for the guarantee function. But this function should not be in force only when the situations are contrary, adverse or the other way around, but a way must be reached in which we can all help each other in the Kingdom. According to Dr. Moses, the Netherlands is obviously a little uneasy with the mere idea that a judge has to make political decisions about this and other situations.
In the situation and constellation in which we are within the Kingdom, legal disputes will arise and it is important to have an impartial body to give its point of view in this regard. Just as everyone can go to the judge in search of their rights, this must be the case for each country.
