WILLEMSTAD.- According to Lawyer Achim Henriquez, Curaçao did not ratify the treaty for refugees that counts for the other parts of the kingdom. As a consequence of this Curaçao does not know a formal asylum system. But according to Henriquez Curaçao has to follow the European Convention on Human Rights in its art. 3 that opposes the expulsion. You cannot send a person back against their will.
Henriquez sent a letter to the Minister of Justice Quincy Girigorie on August 21st, requesting asylum for a Venezuelan military officer who recently defected from the Venezuelan army. Now he is locked in the barracks of SDKK. He fears for his life if Curaçao sends him back to Venezuela, for which he requested asylum through his lawyer.
According to Henriquez Curaçao, he does not know an asylum management system for the country, but he can give asylum. In his letter, Henriquez wrote to Minister Girigorie, that a person requesting asylum has the right to wait for a response on his petition in the country in which he has made the request, and in this case is Curaçao.
