WILLEMSTAD - The Government of Curacao and RdK won a summary judgment that they initiated against the former president of MDPT, Werner Wiels to deliver the documents that Wiels hid or has in his power still. This on the matter of looking for a partner to rent Isla Refinery after December 2019. The judge ordered Wiels to deliver all the documents. Today Wiels will have a press conference to inform more details about this case.

The Government of Curacao and Curacao Refinery (RdK) filed a summary judgment against Werner Wiels to deliver all the documents he has in his possession of MDPT (Multidisciplinair Projectteam). Werner Wiels was the president of MDPT from 2013 until mid-2017.

In mid-2016 and early 2017, the government concluded an agreement with GZE and CZR related to the operation of Refineria and Titan was also designated as the preferred bidder or the highest bidder for the construction of an oil terminal.

As indicated previously, the Government is asking Wiels to provide copies of all MDPT data considering that they are owned by the government of Curacao.

The debate between the parties was divided on the question of whether the request of the Government and its interest for Wiels to deliver the documents according to Article 843aRv is really justified.

Wiels denied it indicating that the Government and RdK have all the data related to the Project and MDPT. During the hearing of the case in the Court, Wiels complained about the way he was treated. He noted that the secretary of the current president of MDPT was bothered by e-mails and or phone calls demanding the delivery of the documents in reference.

It was evidenced that MDPT under the leadership of Wiels spent 16.8 million guilders. MDPT is responsible for making a report about their work.

For the government and RdK it is of great importance that they have all the documents, so that they can finish addressing the issues with GZE. Therefore they require each and every one of the documents to verify that MDPT work was done and also that they talked or negotiated with GZE and the other parties that were interested.

What makes the situation difficult is that Wiels used his personal computer to deal with MDPT issues as well.

This is an objective situation for which the judge gave the government and RdK reason. An example is the list of 23 companies that were interested in renting Refineria. From the interview with the MDPT consultants it was shown that Wiels is the only one that has all the documents of the companies that were interested in the Refinery but still cannot find these documents.

Wiels did not say anything on this matter, that he is the only one that has the list of companies interested in renting Refinery.

Taking into account these the points mentioned above and combined with the statement of Wiels during the hearing of the case, the judge reached his conclusion that the request of the Government and RdK is justified to obtain all the data of MDPT that Wiels has in his power.

The judge ordered Wiels to give the government and RdK all the data. On the basis of article 3: 300 BW, the court instructed Ramazan to retain Wiels' computer. And even the Judge gave approval to look for an expert in ICT in order to look for the documents in the computer of Wiels. If between Wiels and the Government/RdK an agreement on the delivery of these documents is not reached, Ramazan must report this to Court by June 18th.
