WILLEMSTAD.- The Legalization Commission (from now on, Council) carried out an investigation on the problematic related to illegal immigration of Venezuela. The Council intended to give a view of the situation related to this problem and verify, controlling how advanced are the achievements of the desired results.

LEGAL PICTURE

The Council observed that the rules regarding the combat of illegal stay in Curaçao and the crimes related to this issue, such as: trafficking and smuggling of persons are indicated respectively in the Admission Ordinance and the Penal Code of Curaçao.

The Council believes that the existing legislation offers sufficient services and means to address illegal migration from Venezuela.

MANAGEMENT

The government formulated a management that sets the conditions to deal with illegal migration from Venezuela. In spite of that, not all conditions were realized. The Council considers that, in order to address this issue effectively, there must be a reasonable minimum capacity of available cells, an effective expulsion management, the identification of persons smugglers and a criminal group can happen quickly enough.

COLLABORATION AND INTEGRAL INFORMATION FLOW

The investigation showed that it installed a Strong and Broad Task Organization, but not always the Organization in question is involved in fixing the agenda items. In addition, the execution of action points by administrative organizations are not the responsibility of Strong Tasks. The Council considers that the efforts of the Government are adequate, but also believes that the level of collaboration should be improved.

The Ministry of Internal Affairs has contact with some South American countries such as the IOM (International Organization for Migration) and with the Venezuelan authorities via the Embassy of Caracas, regarding the problem of possible asylum request from citizens of Venezuela.

Not all parties send information and it is not making good use of some sources of information that exist within the Venezuelan community. For these reasons, the Board considers that it has spaces to improve the flow of information.

MEDIUM

The capacity of available cells is insufficient and there is room to improve the way the radar is being used. To finance the return trip, you approach the families of undocumented persons and the consulate. The Council considers it necessary to increase the capacity of the available cells and study the possibility of buying a new radar. It should also study the possibility of charging, for example, the smugglers of persons or those who are directing such operations of transportation of illegal or undocumented persons, for the expenses of return.
